Creator Gifting & Payout Terms

1. Becoming Eligible to Receive Gifts

To receive Gifts, you ("Creator," "you") must connect a payout account through our payment processor, Stripe, by completing Stripe Connect onboarding (including any identity and tax-information requirements Stripe imposes). Until Stripe confirms your account is fully enabled for payouts, you cannot receive Gifts. We may decline, pause, or revoke gifting eligibility at our discretion, including where required by Stripe, Stripe temporarily disables payout, by law, or by these terms.

2. What You Receive

When a viewer sends you a Gift, the Gift amount is processed by Stripe and split as follows:

• Stripe's payment-processing fee is deducted first.
• DrewStac LLC retains a platform fee — a percentage of the remaining amount.
• You receive the remaining balance (your "Creator Share"), paid to your connected Stripe account.

Your Creator Share percentage is disclosed to you in-product and may be changed on a going-forward basis with notice. Because processing fees are deducted before the split, your effective share of the original Gift amount is lower on smaller Gifts.

3. Payouts Are Handled by Stripe

Payouts are processed through Stripe and Stripe Connect. DrewStac LLC does not guarantee payout timing, availability, or release of funds. Funds may be delayed, withheld, reversed, reserved, refunded, or charged back under Stripe's rules, these Terms, or applicable law. Questions about payout timing, balances, holds, or bank details are governed by your relationship with Stripe. The earnings figures shown to you inside DrewStac Live reflect our records of Gifts you've received and are informational; the authoritative record of your balance and payouts is your Stripe dashboard.

4. Taxes and Reporting

You are responsible for determining and paying all taxes owed on amounts you receive. DrewStac LLC, Stripe, or another payment processor may collect tax information and may issue tax forms where required by law. Depending on the payment-processing structure, DrewStac LLC or Stripe may be responsible for certain tax reporting. You are responsible for keeping all tax information accurate.

5. Refunds, Chargebacks, and Reversed Gifts

Gifts are sold to viewers as final and non-refundable, but card networks still permit viewers to dispute charges, and refunds may occur in limited cases. If a Gift you received is later refunded, charged back, or successfully disputed:

• That Gift is removed from your earnings records, and
• DrewStac LLC currently absorbs the resulting loss at the platform level and does not claw back your Creator Share for that Gift, except in cases of fraud, creator misconduct, self-gifting, collusion, prohibited content, or violation of terms.

6. No Solicitation of Prohibited Conduct

You may not solicit, promise, condition, or imply that Gifts will be exchanged for: sexual or adult content; anything unlawful; off-platform payments designed to evade these terms; or any conduct that violates our Community Guidelines or master Terms of Service. You may not arrange, encourage, or participate in self-gifting, collusive gifting, or any scheme designed to generate Gifts from fraudulent or unauthorized payments. You must disclose paid promotions, affiliate commissions, sponsorships, free products, brand relationships, and other material connections. Violations may result in withheld eligibility, reversal of associated amounts where permitted, and suspension or termination.

7. Your Relationship With DrewStac Live

Receiving Gifts does not make you an employee, agent, partner, or joint venturer of DrewStac Live. You are an independent party using the Platform. You are responsible for your own conduct, content, and compliance with applicable law, including any licensing, registration, or disclosure obligations that apply to you.

8. Suspension and Termination

We may suspend or terminate your gifting eligibility or account — and, where permitted, withhold or reverse amounts associated with violations — if you breach these terms, if Stripe restricts your account, if we detect fraud or abuse, or as required by law. Amounts legitimately earned and already paid out by Stripe are not affected by a later suspension, except as permitted for fraud or chargeback recovery. In cases of suspected violations, reviews will be pending, DrewStac LLC may pause gifting eligibility while investigating any suspicious activity.

9. Changes

We may change the gifting feature, the Gift catalog, the platform fee (following prior notice), the Creator Share, or these terms at any time on a going-forward basis. Continued use of gifting after a change takes effect constitutes acceptance.
