Virtual Gifts Terms

1. What Gifts Are

DrewStac Live, a platform and product of DrewStac LLC ("DrewStac LLC," "we," "us," or the "Platform") lets registered viewers send virtual gifts ("Gifts") to hosts and creators ("Creators") during live streams. A Gift is a voluntary tip made to show appreciation and support for a Creator. Sending a Gift does not entitle you to any product, service, deliverable, promise, or performance from the Creator or from DrewStac LLC. Gifts are not investments, donations to a registered charity, deposits, stored value, or currency, and they carry no cash value to the sender once sent.

The on-screen animations and effects associated with Gifts are cosmetic and exist only to express and display your support during a stream. They confer no ongoing rights, ownership, or value.

2. Minor Eligibility, Age Controls, and Gifts

DrewStac Live is not intended for children under 13 years old. You may not create an account, access the Platform, or provide personal information to DrewStac LLC if you are under 13. If we learn or reasonably believe that an account belongs to a child under 13, we may suspend or terminate the account and delete associated personal information, except where retention is required or permitted by law.

Where required by applicable law, including laws that apply to certain social media platforms, we may restrict, suspend, terminate, or require verified parental or guardian consent for accounts held by minors. This may include prohibiting users under a legally required minimum age from creating or maintaining accounts and requiring parent or guardian consent for certain teen users before they may create, maintain, or continue using an account.

Gifts may be purchased or sent only by users who are at least 18 years old. By purchasing or sending a Gift, you represent and warrant that you are at least 18 years old, that the payment method you use belongs to you or is authorized for your use, and that you are legally permitted to make the transaction. We may require age checks, payment verification, identity verification, fraud screening, parental-consent verification where applicable, or other safeguards before allowing account access, gifting, payouts, or other Platform features.

If we learn or reasonably believe that a user is underage, has misrepresented their age, is using an unauthorized payment method, or is attempting to bypass our age, payment, or safety controls, we may refuse, limit, reverse, or cancel Gifts; disable gifting privileges; suspend or terminate the account; remove associated content or personal information where required by law; and take other actions permitted by these Terms, our Privacy Policy, Stripe's rules, or applicable law.

Parents or legal guardians who believe a minor has created an account, provided personal information, or made a Gift without proper authorization may contact us at contact@drewstac.com. We may request information reasonably necessary to verify the request and take appropriate action.

3. Pricing and Payment

Each Gift has a price displayed at the time of purchase, charged in U.S. dollars. When you send a Gift, you authorize us, through our third-party payment processor (Stripe), to charge your selected payment method for the full displayed amount.

If you choose to save your payment method for faster future Gifts, you authorize us and Stripe to store it and to charge it for subsequent Gifts you initiate, until you remove it or revoke that authorization. You can be charged only for Gifts you choose to send; we do not charge saved payment methods without an action by you to send a Gift.

4. All Sales Are Final — Gifts Are Non-Refundable

All Gift purchases are final. Gifts are non-refundable and non-reversible by the sender once sent, except where a refund is required by applicable law or is granted by DrewStac LLC in its sole discretion. Because a Gift is a voluntary tip rather than a purchase of goods or services, you should be certain before sending.

This policy does not eliminate any rights your card issuer or the card networks provide regarding disputed charges. If you believe a charge was unauthorized or erroneous, contact us first at contact@drewstac.com so we can help resolve it.

5. How Gift Funds Are Handled

DrewStac Live uses Stripe, including Stripe Connect, to process Gift payments and to pay Creators. When you send a Gift:

• DrewStac LLC retains a platform fee (a percentage of the Gift amount after payment-processing fees).
• The remaining portion is paid to the Creator through the Creator's connected Stripe account.

Payments and payouts are processed through Stripe and Stripe Connect. Depending on the payment flow, funds may be processed, transferred, reserved, delayed, reversed, refunded, or charged back through Stripe and/or DrewStac's platform account in accordance with Stripe's rules, these Terms, and applicable law.

The exact platform-fee percentage and Creator share are disclosed to Creators in the Creator-facing materials and may be updated from time to time on a going-forward basis.

6. Chargebacks and Disputes

If a Gift payment is refunded, charged back, or disputed through the card networks, DrewStac LLC may remove the corresponding amount from the relevant earnings records and may take the resulting loss at the Platform level. We may suspend or terminate the gifting privileges — or the account — of any user associated with fraudulent charges, excessive chargebacks, or other abuse. We may also decline or reverse Gifts we reasonably believe to be fraudulent, unauthorized, or in violation of these terms.

7. Sending Limits

To protect against fraud and abuse, DrewStac LLC applies limits on how frequently and how much a user may send in Gifts over a given period. These limits may change at any time and may cause a Gift attempt to be declined. Hitting a limit is not a malfunction.

8. No Endorsement; Conduct

Gifts do not create any partnership, employment, agency, or endorsement relationship between a sender, a Creator, and DrewStac Live. You may not use Gifts to launder money, to make payments for unlawful goods or services, to harass any person, or to circumvent any limit, ban, or restriction. Creators may not condition, solicit, or promise unlawful, adult, or prohibited content or off-platform consideration in exchange for Gifts. DrewStac LLC may reverse, withhold, suspend, offset, or remove earnings if a Creator violates these rules.

9. Taxes

Creators are responsible for reporting and paying all taxes on amounts they receive. DrewStac LLC, Stripe, or other payment processors may collect tax information and issue tax forms where required by law. Receipt or non-receipt of a tax form does not determine whether income is taxable.

10. Changes

We may modify, suspend, or discontinue the gifting feature, the Gift catalog, or pricing at any time. Changes apply on a going-forward basis and do not entitle you to a refund of Gifts already sent.
